1. General information

This subject gathers the ethical and legal knowledge that the nursing student must learn in order to practice the profession with responsibility. Healthcare practice encompasses multiple humanistic and social aspects such as confidentiality, professional secrecy, respect for human dignity and non-discrimination. In addition, ethical dilemmas faced by nursing professionals in their daily work are raised in this subject. The student will be able to rely on class content and ethical and moral principles to actively participate and present their critical reasoning.

These approaches are aligned with the Sustainable Development Goals (SDGs) of the United Nations 2030 Agenda (https://www.un.org/sustainabledevelopment/es/), and certain specific targets, such that the learning results of the subject will contribute in some way to the overall achievement of SDG 3; health and well-being, Objectives 5.2,5.3 and 5.6 of goal 5 and targets 10.2 and 10.3 of Goal 10.

2. Learning results

1. To know and acquire theoretical and practical knowledge of the legal-social context and the ethical and legal bases and on which their future professional practice should be based. (CG12, CE15, CE49, CE58).

2. To learn, apply and individualize care, guaranteeing the right to dignity, privacy, intimacy, confidentiality and decision-making capacity of the patient and family, as well as age, gender, cultural or ethnic differences and beliefs or values (CE54, CE53, CG12, CG18, CG07).

3. To know how to adapt their actions to the changing legal framework and to a rapidly evolving scientific scenario that creates new ethical challenges in the practice of health professions (CE49, CE52)

4. To complete their training by improving their capacity for reflection, thinking and critical reasoning on medical-legal dilemmas as well as the capacity for synthesis and teamwork that allows them to assume an ethical commitment to their personal and professional development (CT01, CT02, CT03 and CT13).

3. Syllabus

BLOCK 1. HEALTH LEGISLATION AND PROFESSIONAL PRACTICE

Unit 1: Introduction to law and functions of law in social life. Legal standard.
Unit 2: Legal framework of the health professions: Spanish Constitution 1978. Law 14/1986, of April 25, 1986, General Health Law. Law 41/2002, of November 14, 2002, basic law regulating patient autonomy and rights and obligations regarding clinical information and documentation.
Unit 3: The sanitary act. Competencies of the nursing profession. Law of Regulation of the Health Professions.
Unit 6. Spanish Nursing Code of Ethics.
Unit 10. Occupational accident and occupational disease. Occupational hazards in nursing practice.

BLOCK 2. BIOETHICS

Unit 4: Confidentiality and professional secrecy. Patient rights and clinical safety.
Unit 5: Concept and history of ethics.
Unit 7: Genetic manipulation, assisted reproduction and surrogacy.
Unit 8: Ethical aspects of care during pregnancy. Voluntary Interruption of Pregnancy.
Unit 9: Ethics in paediatric care. Child abuse.
Unit 11: Assistance to victims of domestic violence and gender violence.
Unit 12: Ethical aspects of the care of immigrants. Female genital mutilation.
Unit 13: Ethics in the care and assistance to the elderly and disabled.
Unit 14: Ethical aspects of research with human subjects.
Unit 15: Ethics in the assistance and care of people at the end of life.
Unit 16: Relevant ethical aspects in organ donation and transplantation.
Unit 17: Conscientious objection.

4. Academic activities

Participatory lectures 50 hours.

The teaching methodology will be by means of face-to-face and interactive lectures, as well as different compulsory activities to improve the acquisition of the contents.

Problem solving and case studies: 10 hours.

Attendance to the seminars is not mandatory. They are based on improving knowledge through practical activities in problem solving and implementation of theoretical content, in addition to promoting and acquiring active learning aimed at the development of critical thinking by the student, debate and reflection of different ethical and legal aspects.

Study and personal work: 60 hours

Assessment tests. 6 hours

5. Assessment system

The student must demonstrate achievement of the intended learning results through the following assessment activities:

1. Theoretical evaluation exams. 75% of the final grade.

The theoretical evaluation of this subject will be carried out throughout the academic year by means of two tests or written mid-term exams (P1, P2), the dates of which will be determined at the beginning of the term depending on the official calendar of the Center and in school periods without classes.
The maximum grade of the test will be 10 points, being necessary to obtain a minimum of 5 points to pass it
The tests will consist of 50 multiple-choice questions, with 4 possible answers, only one valid. Negative points are not considered and the cut-off point is set at 35 right answers to obtain a 5 out of 10.
There will be two tests or midterms. All students (groups 1 and 2) will take the same exam on the same day.
The first will take place at the end of the first module of both groups; the second at the end of the second module
In the case of failing or not taking a midterm exam, the student will have the opportunity to recover it in the official calls (1st and 2nd).
The average of the two mid-term exams will be taken, being necessary that both are passed in order to be able to take this average
The weighting of the exams on the final grade of the subject will be 75%.

2. Practical activities consisting of seminars, continuous evaluation work and class participation. 20% of the final grade.

Completion of the work proposed in class and on the Moodle platform.
Continuous oral, individual and group evaluation for the practices proposed in the seminars.
Participatory attitude in class and for the resolution of ethical-legal dilemmas.

3. Seminar attendance. 5% of the final grade.

The faculty may request an attendance sheet as they deem appropriate.

In the evaluation and activities, the characteristics of the center where the degree is taught will be taken into account for Huesca and Teruel, always ensuring the acquisition of competencies.

1. Información básica de la asignatura

Esta asignatura reúne los conocimientos éticos y legales que el estudiante de enfermería debe aprender para ejercer la profesión con responsabilidad. La práctica sanitaria engloba múltiples aspectos humanísticos y sociales como la confidencialidad, el secreto profesional, el respeto a la dignidad humana y la no discriminación. Además, en esta asignatura se plantean dilemas éticos a los que se enfrentan los profesionales de enfermería en su quehacer diario. El alumno podrá apoyarse en los contenidos de clase y en los principios éticos y morales para participar de forma activa y exponer su razonamiento crítico.

Estos planteamientos están alineados con los Objetivos de Desarrollo Sostenible (ODS) de la Agenda 2030 de Naciones Unidas (https://www.un.org/sustainabledevelopment/es/), y determinadas metas concretas, de tal manera que los resultados de aprendizaje de la asignatura contribuirán en cierto modo al logro general del ODS 3; salud y bienestar, las metas 5.2,5.3 y 5.6 del objetivo 5 y las metas 10.2 y 10.3 del ODS 10.

2. Resultados de aprendizaje

Conocer y adquirir conocimientos teóricos y prácticos del contexto jurídico-social y, las bases éticas y legales sobre las que se debe cimentar su futuro ejercicio profesional. (CG12, CE15, CE49, CE58).
Aprender, aplicar e individualizar los cuidados, garantizando el derecho a la dignidad, privacidad, intimidad, confidencialidad y capacidad de decisión del paciente y familia, así como la edad, el género, las diferencias culturales o étnicas y las creencias o valores (CE54, CE53, CG12, CG18, CG07).
Saber adaptarse en sus actuaciones al marco legal cambiante y a un escenario científico de rápida evolución que crea nuevos retos éticos en el ejercicio de las profesiones sanitaria (CE49, CE52)
Completar su formación mejorando la capacidad de reflexión, pensamiento y razonamiento crítico sobre dilemas y cuestiones médico-legales así como capacidad de síntesis, trabajo en equipo que permita asumir un compromiso ético su desarrollo personal y profesional (CT01, CT02, CT03 y CT13).

3. Programa de la asignatura

BLOQUE 1. LEGISLACIÓN SANITARIA Y EJERCICIO PROFESIONAL

Tema 1: Introducción al derecho y funciones del derecho en la vida social. Norma jurídica.

Tema 2: Marco jurídico de las profesiones sanitarias: Constitución Española 1978. Ley 14/1986, de 25 abril, General de Sanidad. Ley 41/2002, de 14 de noviembre, básica reguladora de la autonomía del paciente y de derechos y obligaciones en materia de información y documentación clínica

Tema 3: El acto sanitario. Competencias de la profesión de enfermería. Ley de Ordenación de las Profesiones Sanitarias.

Tema 6. Código deontológico de la enfermería española.

Tema 10. Accidente de trabajo y enfermedad profesional. Riesgos laborales en la práctica enfermera.

BLOQUE 2. BIOÉTICA

Tema 4: Confidencialidad y secreto profesional. Derechos de los pacientes y seguridad clínica.

Tema 5: Concepto e historia de la ética.

Tema 7: Manipulación genética, reproducción asistida y maternidad subrogada.

Tema 8: Aspectos éticos de la atención durante el embarazo. Interrupción voluntaria del embarazo.

Tema 9: Ética en la atención pediátrica. Maltrato infantil.

Tema 11: Asistencia a víctimas de violencia doméstica y violencia de género.

Tema 12: Aspectos éticos de la atención de personas inmigrantes. Mutilación genital femenina.

Tema 13: Ética en la atención y asistencia a los ancianos y discapacitados.

Tema 14: Aspectos éticos de la investigación con seres humanos.

Tema 15: Ética en la asistencia y cuidados de personas al final de la vida.

Tema 16: Aspectos éticos relevantes en la donación y trasplante de órgano.

Tema 17: La objeción de conciencia.

4. Actividades académicas

Clase magistral participativa: 50 horas.

La metodología de enseñanza será mediante lección magistral presencial e interactiva, así como diferentes actividades prácticas obligatorias que mejoren la adquisición de los contenidos.

Resolución de problemas y casos: 10 horas.

La presencialidad a los seminarios no será obligatoria. Están basados en mejorar conocimientos mediante actividades prácticas en la resolución de problemas y puesta en práctica de los contenidos teóricos, además de fomentar y adquirir un aprendizaje activo encaminado al desarrollo del pensamiento crítico por parte del estudiante, debate y la reflexión de diferentes aspectos éticos y legales.

Estudio y trabajo personal: 60 horas

Pruebas de evaluación: 6 horas

5. Sistema de evaluación

El estudiante deberá demostrar que ha alcanzado los resultados de aprendizaje previstos mediante las siguientes actividades de evaluación:

Exámenes de evaluación teórica. 75% de la nota final.

La evaluación teórica de esta asignatura se realizará a lo largo del curso académico mediante dos pruebas o exámenes parciales escritos (P1, P2), cuyas fechas se determinarán a principio de curso en dependencia del calendario oficial del Centro y en periodos lectivos sin clases.
La puntuación máxima de la prueba será de 10 puntos, siendo preciso para superarla obtener un mínimo de 5 puntos.
Las pruebas consistirán en 50 preguntas tipo test, con 4 respuestas posibles, una sola válida. No se consideran puntos negativos y el punto de corte se establece en 35 aciertos para obtener un 5 sobre 10.
Se realizarán dos pruebas o parciales. Todos los alumnos (grupos 1 y 2) realizarán el mismo examen y el mismo día. El primero de ellos tendrá lugar al finalizar el primer módulo de ambos grupos; el segundo al finalizar el segundo módulo.
En el caso de que se haya suspendido o no presentado algún parcial, el alumno/a tendrá la oportunidad de recuperarlo en las convocatorias oficiales (1ª y 2ª).
Se realizará la media de los dos parciales, siendo necesario que ambos estén aprobados para poder realizar dicha media.
La ponderación de los exámenes sobre la calificación final de la asignatura será del 75%.

Actividades prácticas de los seminarios, trabajos de evaluación continua y participación en clase. 20% de la nota final.

Realización de los trabajos que se proponen en clase y en plataforma Moodle.
Evaluación continua oral, individual y de grupo para las prácticas planteadas en los seminarios.
Actitud participativa en clase y para la resolución de dilemas éticos-jurídicos.

Asistencia a los seminarios. 5% de la nota final.

El profesorado podrá solicitar hoja de asistencia cuando estime oportuno.

En la evaluación y actividades se tendrán en cuenta para Huesca y Teruel las características del centro donde se imparte la titulación, asegurando siempre la adquisición de las competencias.
